What matters legally at completion
A contract is formed through matching declarations. The general rules on formation and sufficiently definite consent include sections 861 and 869 of the Austrian Civil Code (ABGB). The required form and representation depend on the contract, the parties and any special rules that apply.
Interpretation is not limited to isolated words. Section 914 ABGB refers to the parties’ intention and honest commercial practice. Scope of services, remuneration, options and ancillary rights should therefore be stated clearly enough to prevent later conflict between the contract, annexes and informal discussions.
Regulations may shape the sporting environment as well. The applicable rules depend on the club, competition, federation and registration. Check every dynamic reference and have unclear or conflicting clauses assessed before signing.
